Fando may thereafter use this information to contact the Invited User and invite such user to register with Fando (if such Invited User is not an existing User) and participate in the Game in relation to which such person was invited by the User. Fando allows you to track the balances in the loyalty programs you belong to. Fando Transactions

1. Fando allows you to conduct the following loyalty program currency transactions:

   2. You may exchange your loyalty program currency from one program to another; or
   3. You may redeem your loyalty program currency for gift and stored value cards.
2. The following terms and conditions apply to all transactions you conduct through Fando:
   1. ALL TRANSACTIONS ARE FINAL AND NON-REFUNDABLE. ONCE A TRANSACTION HAS BEEN SUBMITTED IT MAY NOT BE CANCELLED OR REVERSED;

WE RESERVE THE RIGHT TO REVIEW, CANCEL AND REVERSE ANY TRANSACTION IN THE EVENT OF FRAUD, A CHARGE-BACK OF ANY TRANSACTION FEE PAID BY CREDIT CARD, OR AN ERROR OR MISTAKE MADE BY US, INCLUDING ERRORS IN ANY BNRY Coins CONVERSION, REDEMPTION OR SWAP RATE. YOU HEREBY CONSENT TO THE REMOVAL OF BNRY Coins FROM YOUR LOYALTY PROGRAM ACCOUNTS AS REQUIRED BY US TO REVERSE A CANCELLED TRANSACTION;

   1. Exchanging Loyalty Program Currency. In order to complete an exchange of your loyalty program currency from one program (“program A”) to another program (“program B”), you must be a member of both programs. We will first redeem your currency from program A on your behalf and then use the proceeds from that transaction, net of our commission, and any applicable taxes, to purchase the maximum amount of currency in program B possible. The rate you receive from program A for redeeming your currency and the rate charged by program B to acquire currency are determined by the applicable loyalty programs and not by us. With certain exceptions, we generally charge a commission of 15% on the proceeds from the redemption of currency from program A.

Misprints and Errors

We endeavour to provide current and accurate information on Fando regarding the offers and transactions available to you. Nevertheless, errors and misprints occur. Accordingly, we reserve the right to reject, correct, cancel or terminate any transaction for which the price or offer details were incorrectly displayed or for which any other erroneous or inaccurate information was provided. Fando makes reasonable efforts to ensure that the balances displayed to you on Fando are accurate and up to date, we cannot ensure that this will always be the case and hereby disclaims any responsibility for the accuracy of such balances.

Limitation of Liability

Neither Fando its suppliers and/or its loyalty program partners, nor any of our/their affiliates, licensors, suppliers, advertisers, or sponsors, nor any of our/their directors, officers, employees, contractors, consultants, agents, or other representatives, are responsible or liable for any indirect, incidental, consequential, special, exemplary, punitive, or other damages (including, without limitation, damages for loss of business, loss of data, or lost profits), under any contract, negligence, strict liability or other theory arising out of or relating in any way to the Site and/or materials contained on the Site, the software, any linked site or any product or service purchased through the Site.

Your sole remedy for dissatisfaction with the Site, materials, software or any linked site is to stop using the Site, materials, software or linked site, as applicable. Our maximum liability for all damages, losses and causes of action, whether in contract, tort (including, without limitation, negligence) or otherwise, shall in no event exceed the amount paid by you for the transaction giving rise to the claim. Indemnity

You agree to indemnify, defend, and hold BNRY Coins, and our respective affiliates, licensors, suppliers, advertisers, and sponsors, and their respective directors, officers, employees, contractors, consultants, agents, and other representatives, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), and other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement; (b) any allegation that any submissions or other materials you submit to us or transmit to the Site infringe or otherwise violate the copyright, trademark, trade secret, or other intellectual property or other rights of any third party; and/or (c) your activities in connection with the Site.

Entire Agreement, Waiver and Severability

This Agreement, together with any applicable transaction request and confirmation, and our Privacy Policy constitute the entire agreement between you and us with respect to your use of Fando and the processing of any transactions thereon and supersede all prior or contemporaneous agreements or understandings, if any, whether written or oral, relating to such subject matter. No modification, amendment or waiver of this Agreement shall be effective or binding unless made in writing and signed by us. If any of the provisions of this Agreement shall be deemed invalid, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provision.

Force Majeure

We shall have no liability for delays or failure in performance caused by any event beyond our control.

Use of the Term “Partner”

The use of the term “partner” on Fando and in any other materials is not intended to indicate that such a loyalty program is in a legal partnership with us. Rather, the term is used in a marketing sense to show participation by the “partners” in Fando products and services

Order Fulfillment T&Cs for Utilities and Deals

1: Fando’s team shall share the tracking number and tracking link with the user to check on the status of the delivery of the product. User is expected to track the delivery of his product.

2: All communication on the status of the product delivery is communicated with the user via his recorded email.

3: Fando holds no responsibility for the correctness of the email as provided by the User at the time of redemption of the reward. Fando expects the user to check the details in the form before proceeding with the redemption.

4: Product performance, service, warranty, guaranty is not managed by Fando and is to be taken up by the user directly with the merchant/partner.

5: Should the product be of a compromised quality/performance, and if the user returns the product, then the associated Quantity of the Coins will be refunded  on the condition that the respective merchant/partner/vendor accepts the return of the item and confirms full refund of the item to Fando.

6: The order is fulfilled via Fando’s partners depending on the availability of the stock, and serviceability of user’s location by the partner. If the order cannot be fulfilled by Fando’s partner due to any/both of the above reasons then the appropriate Quantity of the Coins will be deposited back to the user’s wallet and she/he will be informed for the same via a email

7: Any/all item to be delivered at your location will depend on the stocks available with the local delivery partner in your region.

8: Return/Refund policy shall follow the associated vendor, and delivery partner’s policy in your region.

9: Fando reserves the rights to change/modify the value of the items at any point.
